Welocity.ai Terms of Use

These Terms of Use (“Terms”) form a legally binding agreement between you and NetConnect Private Limited, operating as Welocity.ai (“Welocity”, “we”, “us”, or “our”), governing your access to and use of the Site and Services (including all subdomains). By accessing or using the Site or Services — including submitting candidate profiles, applications, or other materials — you agree to be bound by these Terms and by our Privacy Policy and Data Processing Agreement available at www.welocity.ai/legal. If you do not agree, please do not use the Site or Services.

By using the Services you also agree to comply with all applicable laws and platform rules. We may update these Terms from time to time; posting revised Terms on the Site constitutes notice. Continued use of the Site or Services after notice of changes constitutes acceptance of the updated Terms.

THIS AGREEMENT CONTAINS AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT WAIVE YOUR RIGHT TO A COURT HEARING OR JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW OR IF YOU OPT-OUT.

To opt out of arbitration, notify us in writing at legal@welocity.ai within thirty (30) days of your first use of the Site or Services. Include your name, email, and a statement that you wish to opt out.

1. Acceptable Use

You may use the Site and Services to:

Learn about Welocity, our AI-powered recruitment platform, and services;
Submit job applications and candidate profiles;
Participate in AI-powered video interviews through Octo;
Post job requisitions and review candidate assessments (for authorized recruiters);
Request information about our products and services.

You shall NOT (and shall not assist any third party to):

Decompile, disassemble, reverse engineer, or attempt to derive source code from the Site or Services;
Distribute, sublicense, or allow third-party use of the Site or Services without authorization;
Modify or create derivative works of the Site or Services;
Upload or transmit content that infringes any third-party rights;
Use the Site or Services for any unlawful, fraudulent, or harmful purpose;
Transmit viruses, malware, or other malicious code;
Scrape, harvest, or collect data from the Site or Services;
Submit inaccurate or misleading information, or misuse any duplicate detection or AI-matching functionality;
Use automated scraping/crawling tools except where expressly authorized in writing by Welocity;
Interfere with or disrupt the Site, Services, or servers;
Use the Services to train or develop competing AI systems or recruitment technologies;
Violate any applicable laws or regulations.

Breach of any acceptable-use rule may result in immediate suspension or termination and civil or criminal liability.

2. User Obligations and Responsibilities

You are responsible for your use of the Site and Services, including all content you submit. You agree to:

Provide accurate, current, and complete information;
Maintain the confidentiality of your account credentials;
Notify us immediately of any unauthorized use of your account;
Comply with all applicable laws and regulations;
Respect the intellectual property rights of others.

You agree to indemnify and hold harmless Welocity, its officers, directors, employees, and agents from and against all third-party claims, damages, losses, liabilities, and costs (including reasonable attorneys' fees) arising out of or relating to: (i) your breach of these Terms; (ii) your misuse of the Site or Services; (iii) content you submit that infringes third-party rights; (iv) your violation of any third-party rights; or (v) any unauthorized use of your account.

3. Data Usage and Platform Intelligence

IMPORTANT: By using our Services, you acknowledge and agree to the following data handling practices:

3.1 Candidate Profile Rights

Candidate Data Access & Retention: Candidate profiles submitted to a client’s requisition will be available to that client for up to sixty (60) days from first submission. After this period, Welocity may retain anonymized or consented data for platform improvement or re-engagement.
Multiple Client Access: The same candidate profile may be presented to multiple clients.
Duplicate Detection: Applies only within specific job requisitions (Job IDs).

3.2 Platform Intelligence

Welocity may process aggregated or anonymized data to improve algorithms, platform performance, and analytics. Identifiable personal data will only be used for cross-client talent matching or reuse with explicit consent or where permitted by law.

4. Intellectual Property Rights

Unless otherwise stated, Welocity and/or its licensors own all intellectual property rights in the Site, Services, and related materials. Users retain ownership of the content they upload. By submitting content, you grant Welocity a worldwide, non-exclusive, royalty-free license to use and display that content solely for providing Services.

All trademarks, service marks, and trade names displayed on the Site are proprietary to Welocity or their respective owners.

5. Privacy and Data Protection

Your use of the Site and Services is subject to our Privacy Policy and Data Processing Agreement available at www.welocity.ai/legal. By using our Services, you consent to the processing of your data as described therein.

6. AI-Powered Services Disclaimer

Our AI-powered assessments are advisory tools only and should not replace human judgment in decision-making. Welocity conducts regular fairness and bias audits, but does not guarantee any specific hiring outcomes.

7. Arbitration

PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS.

Any dispute arising out of or relating to these Terms or your use of the Site or Services shall be resolved exclusively through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India, conducted in Bangalore, Karnataka.

8. Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING AGAINST WELOCITY.

9. Age Requirements

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services.

10. Warranty Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WELOCITY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

To the maximum extent permitted by law, Welocity shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data. Total liability shall not exceed the greater of the amount paid by you in the last 3 months or USD $100.

12. Account Termination and Breach

We reserve the right to suspend or terminate access at any time for breach of these Terms. Upon termination, your rights cease immediately, and data may be deleted.

13. Third-Party Links and Services

The Site may contain links to third-party websites or services. Welocity does not control or endorse third-party content. Use at your own risk.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any claims not subject to arbitration shall be brought exclusively before the courts in Bangalore, Karnataka.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and DPA, constitute the entire agreement.
Severability: If any provision is found invalid, the remainder shall remain in effect.
Waiver: No waiver shall be deemed continuing unless stated in writing.
Assignment: You may not assign these Terms without consent.
Force Majeure: We are not liable for delays caused by events beyond control.
